1. Agreement to these terms
By accessing or using CalorieCap, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service. You must be legally able to enter into this agreement where you live. A parent or legal guardian must approve use by anyone who has not reached the age of legal majority.
2. What CalorieCap provides
CalorieCap helps people search and compare restaurant-published nutrition information, set personal nutrition targets, organize meals, and use related planning features. CalorieCap is an independent service and is not endorsed by or affiliated with the restaurants displayed unless expressly stated.
3. Nutrition and health disclaimer
CalorieCap provides general informational and planning tools, not medical advice, diagnosis, or treatment. Nutrition values can change, may differ by location or customization, and may contain errors or omissions. Confirm important nutrition, ingredient, and allergen information directly with the restaurant. Consult a qualified healthcare professional about medical conditions, eating disorders, pregnancy, allergies, medications, or individualized dietary needs.
4. Accounts and acceptable use
You are responsible for information submitted through your account and for keeping your sign-in credentials secure. You may not misuse the service, interfere with its operation, attempt unauthorized access, scrape or systematically extract its data, reverse engineer protected portions of the service except where law permits, impersonate another person, submit unlawful content, or use CalorieCap to violate another party’s rights.
5. Subscriptions and purchases
Paid features may be offered through Apple, Google Play, RevenueCat-supported purchase flows, or other displayed payment providers. Prices, billing periods, trials, renewal terms, and cancellation instructions are shown before purchase. Subscriptions automatically renew when the purchase terms say they do, unless canceled through the platform that processed the purchase. Deleting your CalorieCap account does not cancel an App Store or Google Play subscription.
6. Your content and shared meals
You retain ownership of content you submit. You give CalorieCap a limited, non-exclusive license to host, process, display, and transmit that content only as needed to provide and improve the service. Anyone with a shared-meal link may be able to view the information included in it. You are responsible for ensuring you have the right to share submitted content.
7. CalorieCap content and intellectual property
CalorieCap, its design, software, branding, and original content are owned by CalorieCap or its licensors and are protected by applicable laws. Restaurant names, logos, menu information, and other third-party materials belong to their respective owners. A limited, revocable, non-transferable license is granted to use CalorieCap for personal, non-commercial purposes in accordance with these terms.
8. Third-party services
CalorieCap may link to or rely on services operated by third parties, including app stores, payment processors, analytics providers, advertising providers, restaurant sources, Apple Health, and Health Connect. Their services are governed by their own terms and policies. CalorieCap is not responsible for third-party services outside our control.
9. Availability and changes
We may modify, suspend, or discontinue features, supported restaurants, or portions of the service. We may also update these terms. When changes are material, we will provide notice where required. Continued use after updated terms take effect means you accept the revised terms.
10. Disclaimer of warranties
To the fullest extent permitted by law, CalorieCap is provided “as is” and “as available.” We disclaim warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, CalorieCap and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from the service. Nothing in these terms limits liability that cannot legally be limited.
12. Termination
You may stop using CalorieCap at any time. We may restrict or terminate access when reasonably necessary to protect users or the service, comply with law, or address a material violation of these terms. Provisions that by their nature should survive termination will continue to apply.
13. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the law where you live requires otherwise.
